Re-Assertion of States’ Rights Resolution

Whereas the tenth amendment of the United States Constitution states that the powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people; and

 

Whereas in Article I, Section 8 the United States government is given defined and limited powers; and

 

Whereas in the modern day system of federalism the United States government funds the several states with the money coming from the citizens of the several states; now therefore

 

Be it resolved that all state legislatures represent the best interest of Kansas, using nullification resolutions, right to recall and other appropriate and Constitutional measures, to stop the United States government from enacting unconstitutional laws in Kansas, and order that rejection of any federal money from unconstitutional federal law must be given back to the citizens, who paid it, or to pay the national debt.

Property Tax Resolution

 

Whereas the fourteenth amendment to the United States Constitution reads that no state may deprive any person of life, liberty, or property; and

 

Whereas a property tax limits the ability to own property; now

 

Be it resolved that all state legislatures represent the best interest of Kansas, eliminate all use and taking of property tax from all forms of political subdivisions within the borders of the state of Kansas.

Enumerated Powers Resolution

 

Whereas Article 1, Section 8, of the United States Constitution enumerates the specific powers granted to the federal government and that such powers are designed to be limited in nature and scope; and

 

Whereas the tenth amendment to the United States Constitution states the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

 

Be it resolved that all United States legislatures elected by Kansas represent the best interest of Kansas, and agree to duly sign and adhere to the following pledge; and

 

Be it resolved that this pledge shall be adhered to: “I solemnly pledge to my constituents that I will consistently vote to not increase the Debt Ceiling but rather to cut, defund and eliminate spending programs, agencies, and departments. not specifically authorized by Section 1, Article 8 of the United States  Constitution as the sole means to meet budgetary shortfalls. No tax increases of any kind shall be considered for meeting existing obligations;” and

 

Be it resolved “I further pledge that for any federal department, program, or activity that I do vote to fund, I will provide the specific enumerated power authorized under the US Constitution. If no such authority exists I pledge to vote nay for continued funding;”

Defense Resolution

 

Whereas the fourteenth amendment to the United States Constitution affirms that no state may deprive any person of life, liberty, or property; and

 

Whereas any person has the ability to defend one’s right to life, liberty, and property; now

 

Be it resolved that all state legislatures represent the best interest of Kansas, eliminate all laws that limit a person’s ability to rightfully defend life, liberty, and property, which includes but is not limited to one’s right to bear arms, as those rights were never given up to a government or political subdivision.

KS GOP Establishment vs. Grassroots Citizens

It has taken some time for the events of the Annual Kansas Day’s weekend to sink in and I am troubled still by the apparent attempt by the “powers that be” in the Republican Establishment to ignore a rather telling vote that took place during the State Committee meeting on the afternoon of Saturday the 29th of January, 2010. As an alternate delegate I was seated as a voting delegate for the duration of the above meeting and I experienced an afternoon of some contentious debate over various topics that were voted upon by the body politic representing the 4 districts of Kansas as well as the seated Executive Committee members present.

From topics ranging from amending the Constitution and By Laws, discussing the work presented by the Think Tank members in an often confusing exchange that brought forth Party Platform debate to clarify nothing more than more work would still need to be taking place as we advance through the coming year. As well as two Resolutions meant to communicate the thoughts and beliefs of the Kansas Republican Party as a whole.

It is to the plight of the Resolutions that I intend to now speak of with the apparent ignoring and omitting of the votes that were taken that day. You see it was Kansas Republican Chairperson Amanda Atkins who posted a rundown of the votes and stands taken during the Kansas Days meeting of the State Committee Meeting, but she omitted perhaps the most telling event of the entire meeting!

 I speak of the Resolution I wrote in support of Kansas University Director of the Center for Applied Economics, Dr. Arthur Hall whose research into a plan for a comprehensive reform/replacement of a Fairtax-model to replace some 37 state-wide taxes with a pro-growth sales tax and pre-bate system. The first matter of record was presented by Kim Borchers when, as acting Resolutions Committee Chairperson, she introduced Resolution “B”, which was the Fairtax model Resolution, ahead of Resolution “A”. This was done because the Resolutions Committee as a whole unanimously approved and favored passage of Resolutions “B” and Resolution “A” was potentially contentious and was not unanimously approved for passage by the Resolutions Committee. So it follows logically to take the “easy” vote first and go back to Resolution “A” after that.

With the unanimous endorsement by the Resolutions Committee and no need for discussion called for by the body politic the vote in consideration of Resolution “B” was brought forth by Chairperson Amanda Atkins. All in favor rang out over the assembled and a chorus of “YES” votes enthused. All opposed? And only the sound of silence echoed forth. Not one single utterance in opposition!

Now wouldn’t you surmise that such and resounding voting endorsement by the State Committee of the Kansas Republican Party would merit some press coverage? Martin Hawver of “Hawver’s Capital Report” was quick to track me down to get my thoughts and I felt quite proud and happy that the Fairtax model proposed by Dr. Hall got such overwhelming positive acceptance. And all this was also witnessed by Chairperson Amanda Atkins herself and yet NO WORD of its passage merited any recognition in her Kansas Day’s Report.

As I now see it we must have a divide between the Establishment Republican’s and the Grassroots Citizens represented by the voting Body Politic that attended the State Committee Meeting that fateful day in January. What do you have to say about such an apparently sad state of affairs? If Resolutions have no place of existence except in the minutes of the next committee meeting than what’s the use?

No mention was made of Resolution “A” in Amanda Atkins Kansas Day Report either, but it was also an important stand to take nonetheless. But the vote for it was not as clear-cut as the vote taken for Resolution “B”. That’s the point of my assertion that the “powers that be” may not appreciate the fairness innate in the Fairtax model presented by Dr. Arthur Hall. And if that is so it is to the Grassroots Citizens to guide its passage to bring the economy back to LIFE in Kansas!

Kansas State Legislature bill called, "hostile act against families"

I just heard on the news that there is a bill working its way through state legislature to extend the Kansas sales to include utility bills. Why?

 

The state budget problems are due to state spending, not the spending of families in Kansas. Families should not have to suffer because bad policy by state lawmakers. I would suggest that the Kansas State legislature trim its budgets. I have seen tables for school funding for this state and the amounts are way too high.

 

If lawmakers want to shift the burden of paying taxes from the income to tax to a broad base sales tax, I would support the move. If it is structured identical to H.R. 25 now before the United States Congress.

 

Any attempt to increase the base of the Kansas Sales tax without both a prebate and a total elimination the Kansas personal and corporate Income tax will be treated by me as a hostile act against families. I hope you will vote against all such bills which simply increase taxes and does not restructure the tax system to give families and business total advantage in today’s hostile global economy.

 

In budget matters, your number one priority is to make sure that the Family budget is fully funded. That is done by getting ride the income tax which attacks hard work and productivity and by restructuring the sales to tax to match H.R. 25. If you need more information go to http://fairtax.org.

 

The Lion’s share of hostility aimed at families is coming from the federal government. We do not need to the state to pile on.

 

I have seen a resolution demanding the federal government respect states rights which is good, but I yet to hear about anyone demanding the federal government respect individual rights. Let’s not forget the War of 1776 to protect individual liberties was wage by 13 state legislatures.

In 1774, the George Washington, acting as a county official, did his duty owed to God rather than men, and helped pass a resolution putting the King and parliament on notice that the lesser government of Fairfax, Virginia was more than willing to defend the Christian Liberties of the British subjects of its county, against the arbitrary power of rouge civil magistrates of the highest level. In 1774, Fairfax County issued a resolution charging that "Resolved that this Colony and Dominion of Virginia cannot be considered as a conquered Country; and if it was, that the presents Inhabitants are the Descendants not of the Conquered, but of the Conquerors." - George Washington Esquire Chairman. It is also quite interesting to see that further down in the 1774 Fairtax County Resolution, that the county government took the opportunity to end the importation of slaves, and declared its “earnest wishes to see an entire stop for ever put to such a wicked, cruel, and unnatural trade.” In our age, where the President and Congress are on the eve of undermining their respective federal authority with a raw display of the arbitrary use of power in the area of national health care, cap and trade, and vote buying scams of U.S. Senator’s votes for special tax dispensation for their respective states, and violating the “general welfare” spirit of the U.S. Constitution, in the finniest tradition of tyrants down the ages. From Roman Emperors to British Kings to socialist dictators like Adolf Hitler and Stalin. We should make practical application of the words written on the Liberty Bell taken right out of Leviticus 25:10, and “Proclaim Liberty throughout all the land unto all the inhabitants thereof” including the unborn. I think it’s also called, “never waste a crisis” by the pro-death forces. Fifteen months after the Fairfax County issued its resolution on April 19th, 1775, Pastor Jonas Clark stood next to widow of a slain militiaman on the Green at Lexington and reminded the world that the Ring of Liberty is not the sound of a bell, but selfless act of a patriot, when he declared that this man had “Driven a death nail into the coffin of Tyranny which will ring into Eternity.” What’s the point in paying county and state taxes, if will not ring Liberty?
